The US Department of Commerce (DOC) has announced that it has not initiated an investigation into evasion of Vietnam’s anti-corrosion steel tax using materials imported from Japan.
According to the Trade Remedies Administration (Ministry of Industry and Trade), the US announced that it would not initiate an anti-dumping investigation on Vietnam’s corrosion-resistant steel (CORE) made from cold rolled steel (CRS) and steel. hot rolled (HRS) imported from Japan.
The US Department of Commerce (DOC) said the plaintiff’s lawsuit lacked grounds to initiate.
Specifically, the product range of the Japan tariff order includes only HRS and CRS and excludes CORE products.
Therefore, the DOC considers that there is no basis to extend the anti-dumping duty on hot-rolled steel (HRS), cold-rolled steel (CRS) of Japan to Vietnam’s CORE products (as specified in Section 781). (c)(2) of the US Tariff Act of 1930).
This is also the argument of Vietnamese businesses and some other stakeholders submitted to the DOC.

DOC believes that the exclusion of CORE products from the tax order with Japan is intentional, because CORE is a popular product and the US has investigated and applied anti-dumping measures to CORE steel in many cases. is different.
Therefore, the plaintiff’s argument is unfounded.
The DOC says this is final on the allegation and will not consider any further comment/request regarding this finding.
Therefore, Vietnam’s CORE steel exporters will not be investigated by the US against tax evasion for allegedly using materials imported from Japan.
However, the Trade Remedies Department recommends enterprises to ensure compliance with regulations on production and certification of origin, to avoid becoming the subject of investigation in other anti-tax avoidance cases in the future.
